The Chief Magistrate erred in law by dismissing the suit for lack of cause of action without perusing the plaint, instead relying on a preliminary and inconclusive survey report. The plaint, on its face, disclosed a cause of action as it alleged the Appellants' rights over the suit land were violated by the Respondents. Furthermore, the procedure adopted breached the Appellants' right to a fair hearing, as they were denied the opportunity to present evidence and challenge the surveyor's report. The dismissal resulted in a miscarriage of justice. The appellate court set aside the ruling and ordered that the suit be heard on its merits.
