The applicant failed to demonstrate sufficient cause for his or his counsel's non-appearance when the suit was called for hearing. The record established that the applicant's counsel was properly served at the address provided in the pleadings, and service on counsel is legally effectual as service on the party. The applicant's argument regarding lack of notice and alleged errors by counsel was unsupported by the pleadings or affidavit evidence. The court found no good reason to set aside the ex parte judgment, as the requirements under Order 9 rule 23 of the Civil Procedure Rules were not met. The application was therefore dismissed with costs.
