The court found that the marriage between the petitioner and respondent was irretrievably broken due to mutual desertion and absence of love and affection. Both parties had lived apart for a considerable period, and the petitioner had returned to Uganda while the respondent remained in Europe. The court was satisfied, after hearing both parties and observing their demeanour, that there was no prospect of reconciliation. The court therefore issued a Decree Nisi dissolving the marriage, to be made absolute within six months.
