Procedural Posture

Criminal Miscellaneous Application / Ruling on Bail Application

  1. 1 Whether the applicants are entitled to bail pending trial for aggravated robbery.
  2. 2 Whether the applicants have proved they have fixed places of abode within the jurisdiction of the court.
  3. 3 Whether the applicants have presented substantial sureties.

Ratio Decidendi

The applicants failed to prove by documentary evidence (LC1 letters or National IDs) that they have fixed places of abode within the jurisdiction of the court, which is a key consideration for bail under Ugandan law. While they presented substantial sureties, the absence of proof of residence raises a significant risk of absconding. No exceptional circumstances were proved to warrant release on bail for a capital offence. The court, exercising its discretion and balancing the applicants' constitutional rights against the interests of justice and public safety, found that the requirements for bail were not satisfied. Consequently, the application for bail was rejected for all applicants.

Court Disposition

application for bail refused

Orders

  • The application for bail by all applicants is not allowed.
  • Applicants to remain on remand pending trial.
