Ratio Decidendi

The court found that the applicant was not the owner of the property that was the subject of the main suit, and therefore had no valid cause of action in conversion. Since a valid cause of action is a prerequisite for amendment of a plaint, and the original plaint was void ab initio for lack of such cause, the application to amend could not be granted. The court emphasized that amendments cannot cure a fundamental defect where the suit is void for want of a cause of action, and that the law prohibits amendments in such circumstances. Accordingly, the application was dismissed with costs.
