The court found that the Local Governments Act is silent on stays of execution in local government election petitions and, by operation of Section 18(5), the vice chairperson assumes office upon removal of the chairperson. Precedent from the Court of Appeal confirms that a stay of execution is not envisaged under the Act. However, to prevent the appeal from being rendered nugatory and in the interest of justice, the court invoked its inherent powers to stay the holding of a by-election for the LCV Chairperson of Abim district until the appeal is determined or until the statutory three-month period for appeal disposal lapses, whichever comes first.
