Miscellaneous Application / Ruling on Bail Application Pending Committal and Trial

  1. 1 Whether the applicant is entitled to bail pending committal and trial for charges of murder and arson.
  2. 2 Whether the applicant has proved a fixed place of abode within the jurisdiction of the court.
  3. 3 Whether the applicant has presented substantial sureties as required by law.

Ratio Decidendi

The court found that while the applicant presented substantial sureties who are related to him and reside within the jurisdiction, he failed to prove a fixed place of abode as required by law. No introduction letter from the LC1 of the applicant's stated residence was attached, and thus the court was not satisfied that the applicant could be traced if he absconded. Given the seriousness of the offences (murder and arson) and the lack of proof of a fixed place of abode, the court exercised its discretion to deny bail. The application was rejected on the basis that the applicant did not meet the mandatory requirement of proving a fixed place of abode within the court's jurisdiction.
