Ltd., (UWFT) Masaka Branch. The appellant, who was employed by Uganda Securic\hich\af0\dbch\af254\loch\f0 o, was on that day deployed to guard the UWFT, Masaka Branch. The Cashier/Accountant, Mr. Tibita Richard, (PW2) was counting the\hich\af0\dbch\af254\loch\f0 money received in the course of the day and }{\f0\fs24\insrsid12461784\charrsid4867004 \hich\af0\dbch\af254\loch\f0 balancing}{\f0\fs24\insrsid8877804\charrsid4867004 \hich\af0\dbch\af254\loch\f0 his till sheet when the appellant entered the banking hall. \par }{\f0\fs24\insrsid3277968\charrsid4867004 \hich\af0\dbch\af254\loch\f0 He had been at the entrance of the Bank. In the banking hall was also the office assistant/mobiliser, Harriet Nakanwagi (PW3). }{\f0\fs24\insrsid658350\charrsid4867004 \hich\af0\dbch\af254\loch\f0 The branch Man\hich\af0\dbch\af254\loch\f0 ager, Sarah Nsimbe (PW4) was in her office, nearby the banking hall. Then two late customers knocked at the door and were allowed into the banking hall. They requested to deposit their money. They were allowed and PW2 received their money which totaled to \hich\af0\dbch\af254\loch\f0 \hich\af0\dbch\af254\loch\f0 UG Shs. 285,000=. He entered that receipt into the late receipt book, put the money in that book which he placed behind the counter. The two customers then went out and the door was closed behind them. }{\f0\fs24\insrsid10688144\charrsid4867004 \hich\af0\dbch\af254\loch\f0 PW2 then returned to continue balancing his till sheet\hich\af0\dbch\af254\loch\f0 \hich\f0 when the unexpected happened. Suddenly the appellant was heard shouting in English language at the top of his voice to the Cashier that \'93}{\b\f0\fs24\insrsid10688144\charrsid4867004 \hich\af0\dbch\af254\loch\f0 gentleman get up, I said get up I want money}{\f0\fs24\insrsid10688144\charrsid4867004 \hich\af0\dbch\af254\loch\f0 \hich\f0 .\'94\loch\f0 PW2 got up raised his hands up while walking slowly towards the appella\hich\af0\dbch\af254\loch\f0 nt as if he was passing him when he turned and grabbed the appellant from behind. Struggle ensued between them. They struggled moving towards the door. The scared Harriet Nakanwagi (PW3) cried out and ran towa}{\f0\fs24\insrsid13318809\charrsid4867004 \hich\af0\dbch\af254\loch\f0 rds the store. Meanwhile the struggle continued\hich\af0\dbch\af254\loch\f0 and when they reached the door}{\f0\fs24\insrsid8920214\charrsid4867004 \hich\af0\dbch\af254\loch\f0 and pushed the appellant inside the banking hall towards PW3. However, seeing the appellant holding his gun in a shooting position, PW4 sensed danger and rushed back into her office closing the door behind her and took cover under her desk. The matter was reported to Police and the appellant was eventually}{ \f0\fs24\insrsid4934552\charrsid4867004 \hich\af0\dbch\af254\loch\f0 arrested and indi\hich\af0\dbch\af254\loch\f0 cted for aggravated robbery contrary to sections 272 and 273(2) of the Penal Code Act.}{\f0\fs24\insrsid8271348\charrsid4867004 \par }{\f0\fs24\insrsid11997459\charrsid4867004 \hich\af0\dbch\af254\loch\f0 He later made a charge and caution statement in which he admitted staging a robbery and stealing some money from the bank. The confession was admitted in evidence by con \hich\af0\dbch\af254\loch\f0 sent. }{\f0\fs24\insrsid10102297\charrsid4867004 \hich\af0\dbch\af254\loch\f0 In his defence, the appellant raised an alibi and belatedly challenged the confession as having been interpreted to him in Alur, a language which he did not understand well. }{\f0\fs24\insrsid4934552\charrsid4867004 \par }{\f0\fs24\insrsid5912020\charrsid4867004 \hich\af0\dbch\af254\loch\f0 The trial judge rejected the appellant\hich\f0 \rquote \loch\f0 s defence and convicted him of simpl\hich\af0\dbch\af254\loch\f0 e robbery as stated earlier in his judgement. He was sentenced as stated earlier in his judgment. He was also ordered to compensate the victim of his crime in the sum of UG. Shillings 184,000=. \par }{\f0\fs24\insrsid16608605\charrsid4867004 \hich\af0\dbch\af254\loch\f0 His appeal to the Court of Appeal was dismissed, hence this ap\hich\af0\dbch\af254\loch\f0 \hich\f0 peal to this court on the sole ground that \'93}{ \i\f0\fs24\insrsid16608605\charrsid4867004 \hich\af0\dbch\af254\loch\f0 \hich\f0 the learned Justices of Appeal erred in law when they failed to properly re-evaluate the prosecution evidence on record and arrived at a wrong conclusion.\'94}{ \f0\fs24\insrsid16608605\charrsid4867004 \par }{\f0\fs24\insrsid12073830\charrsid4867004 \hich\af0\dbch\af254\loch\f0 At the hearing of the appeal, Mr. Tiishekwa A. Rukundo r\hich\af0\dbch\af254\loch\f0 epresented the appellant while Mr. Vincent Okwanga, Senior Principal State Attorney represented the respondent.}{\f0\fs24\insrsid16608605\charrsid4867004 \par }{\f0\fs24\insrsid7171049\charrsid4867004 \hich\af0\dbch\af254\loch\f0 Though he had promised at the pre-hearing conference to file his written submissions by the 8}{\f0\fs24\super\insrsid7171049\charrsid4867004 \hich\af0\dbch\af254\loch\f0 th}{ \f0\fs24\insrsid7171049\charrsid4867004 \hich\af0\dbch\af254\loch\f0 of July 2010, Mr. Rukundo filed the same late on\hich\af0\dbch\af254\loch\f0 13-07-2010, the eve of the hearing date. }{\f0\fs24\insrsid9452065\charrsid4867004 \hich\af0\dbch\af254\loch\f0 On the hearing date, he opted to summarise his written submissions orally. He was allowed to do so.}{\f0\fs24\insrsid12073830\charrsid4867004 \par }{\f0\fs24\insrsid9731791\charrsid4867004 \hich\af0\dbch\af254\loch\f0 He submitted that the learned Justices of Appeal failed to properly re-evaluate the evidence on record as was requ\hich\af0\dbch\af254\loch\f0 ired of them by law and that as a result; they wrongly confirmed }{\f0\fs24\insrsid13632039\charrsid4867004 \hich\af0\dbch\af254\loch\f0 the decision of the trial court when there was no evidence to support that decision. He pointed out that the circumstantial evidence on record did not irresistibly point to the guilt of the a\hich\af0\dbch\af254\loch\f0 ppellant to the exclusion of others. In his view, PW2 did not testify that the appellant knew where the money was placed nor was there evidence which excluded other people from the banking hall to irresistibly point to the appellant as the person who stol \hich\af0\dbch\af254\loch\f0 e\hich\af0\dbch\af254\loch\f0 the money. }{\f0\fs24\insrsid15019780\charrsid4867004 \hich\af0\dbch\af254\loch\f0 He pointed out that PW3 testified that the loss of the money was discovered after some strangers like Edward Mpagi had entered the banking hall.}{\f0\fs24\insrsid5076024\charrsid4867004 \par }{\f0\fs24\insrsid1729144\charrsid4867004 \hich\af0\dbch\af254\loch\f0 He added that in his view, the appellant was convicted on the basis of his retracted confession whi\hich\af0\dbch\af254\loch\f0 ch lacked corroboration. He further submitted that there was no evidence to link the money recovered to the money stolen. \par \par \par }{\f0\fs24\insrsid7350218\charrsid4867004 \hich\af0\dbch\af254\loch\f0 He prayed that the appeal be allowed, conviction quashed, the sentence and the order imposed on the appellant be set aside. That the\hich\af0\dbch\af254\loch\f0 appellant be set free. }{\f0\fs24\insrsid1729144\charrsid4867004 \par }{\f0\fs24\insrsid2513060\charrsid4867004 \hich\af0\dbch\af254\loch\f0 On the other hand, Mr. Okwanga supported the conviction and the sentence with the order imposed on the appellant. He submitted that the record shows that the learned Justices of Appeal properly re-evaluated the evidence on record an \hich\af0\dbch\af254\loch\f0 d correctly found the appellant guilty of the offence. In his view, there is overwhelming circumstantial evidence which irresistibly point to the }{\f0\fs24\insrsid1971699\charrsid4867004 \hich\af0\dbch\af254\loch\f0 appellant \hich\f0 \rquote \loch\f0 s}{\f0\fs24\insrsid2513060\charrsid4867004 \hich\af0\dbch\af254\loch\f0 guilt.}{\f0\fs24\insrsid7350218\charrsid4867004 \par }{\f0\fs24\insrsid10363499\charrsid4867004 \hich\af0\dbch\af254\loch\f0 He pointed out that when PW2 had a brief scuffle with the appellant, there was loose money \hich\af0\dbch\af254\loch\f0 behind the counter. When PW2 ran out for his dear life, the appellant was left alone in the banking hall where the money was. When it was later checked, the money was found missing and the appellant had disappeared without handing over the station to anot \hich\af0\dbch\af254\loch\f0 h\hich\af0\dbch\af254\loch\f0 er guard.}{\f0\fs24\insrsid2513060\charrsid4867004 \par }{\f0\fs24\insrsid11875128\charrsid4867004 \hich\af0\dbch\af254\loch\f0 Learned Senior Principle State Attorney submitted that the circumstantial evidence, including the appellant\hich\f0 \rquote \loch\f0 s conduct, corroborated his charge and caution statement in which he admitted the theft. The confession was admitted in evidence by consen\hich\af0\dbch\af254\loch\f0 t and that its late challenge by the appellant was an afterthought. That the appellant \hich\f0 \rquote \loch\f0 s disappearance from his guard duty without handing over to his colleague was a conduct inconsistent with innocence. \par }{\f0\fs24\insrsid11093318\charrsid4867004 \hich\af0\dbch\af254\loch\f0 He prayed that the appeal be dismissed. \par \par \par }{\f0\fs24\insrsid15206563\charrsid4867004 \hich\af0\dbch\af254\loch\f0 The above \hich\af0\dbch\af254\loch\f0 arguments of counsel raise the issue of the role of a second appellate court. This is not a new point. It is an issue which has had judicial consideration before. In }{\b\i\f0\fs24\insrsid15206563\charrsid4867004 \hich\af0\dbch\af254\loch\f0 Rex \hich\f0 \endash \loch\f0 vs \hich\f0 \endash \loch\f0 Hassan Bin Said alias Kimani Somali (1942) 9 EACA 62}{\f0\fs24\insrsid15206563\charrsid4867004 \hich\af0\dbch\af254\loch\f0 , the former Eastern Africa\hich\af0\dbch\af254\loch\f0 Court of Appeal considered the role of a second appellate court and held that an appeal to a second appeal is purely on question of law. See also s.5 (a) of the Judicature Act and the case of }{\b\i\f0\fs24\insrsid15206563\charrsid4867004 \hich\af0\dbch\af254\loch\f0 Kifamunte}{\f0\fs24\insrsid15206563\charrsid4867004 \hich\af0\dbch\af254\loch\f0 (intra)}{\f0\fs24\insrsid11093318\charrsid4867004 \par }{\f0\fs24\insrsid2627877\charrsid4867004 \hich\af0\dbch\af254\loch\f0 A second appellate court is precluded from qu\hich\af0\dbch\af254\loch\f0 estioning the concurrent findings of facts by the trial and first appellate courts, provided that there was evidence to support those findings though it may think it possible or even probable that it would not have come to the same conclusion. \par }{\f0\fs24\insrsid9726384\charrsid4867004 \hich\af0\dbch\af254\loch\f0 A second app\hich\af0\dbch\af254\loch\f0 ellate court can only interfere with such finding where there was no evidence to support the finding because this is a question of law.}{ \f0\fs24\insrsid3233837\charrsid4867004 \par }{\f0\fs24\insrsid9726384\charrsid4867004 \hich\af0\dbch\af254\loch\f0 Inference legitimately drawn from proved facts by the trial and first appellate courts must establish the guilt beyond a\hich\af0\dbch\af254\loch\f0 ll reasonable doubt. \par }{\f0\fs24\insrsid9010843\charrsid4867004 \hich\af0\dbch\af254\loch\f0 The above principles were echoed by the former Court of Appeal for East Africa in }{\b\i\f0\fs24\insrsid9010843\charrsid4867004 \hich\af0\dbch\af254\loch\f0 Okeno \hich\f0 \endash \loch\f0 vs \hich\f0 \endash \loch\f0 Republic (1972) EA 32}{\f0\fs24\insrsid9010843\charrsid4867004 \hich\af0\dbch\af254\loch\f0 , where it said:}{\f0\fs24\insrsid9726384\charrsid4867004 \par }\pard \qj \li720\ri432\sb240\sa200\widctlpar\aspalpha\aspnum\faauto\adjustright\rin432\lin720\itap0\pararsid10426780 {\b\f0\fs24\insrsid10426780\charrsid4867004 \loch\af0\dbch\af254\hich\f0 \'93\loch\f0 It is appropriate on a second appeal only to decide whether a judgment can be supported on the facts \hich\af0\dbch\af254\loch\f0 as found by the trial and first appellate court as this is purely a question of law}{ \f0\fs24\insrsid10426780\charrsid4867004 \hich\af0\dbch\af254\loch\f0 \hich\f0 .\'94}{\f0\fs24\insrsid9010843\charrsid4867004 \par }\pard \qj \li0\ri0\sb240\sa200\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12082901 {\f0\fs24\insrsid10426780\charrsid4867004 \par }{\f0\fs24\insrsid2627877\charrsid4867004 \par }{\f0\fs24\insrsid15206563\charrsid4867004 \par }{\f0\fs24\insrsid4673604\charrsid4867004 \hich\af0\dbch\af254\loch\f0 This court has had occasion to re-state the principles in }{\b\i\f0\fs24\insrsid4673604\charrsid4867004 \hich\af0\dbch\af254\loch\f0 Kifamunte Henry \hich\f0 \endash \loch\f0 vs \hich\f0 \endash \loch\f0 Uganda}{\f0\fs24\insrsid4673604\charrsid4867004 \hich\af0\dbch\af254\loch\f0 , an appeal No. 10 of 1997, when it said:}{\f0\fs24\insrsid11875128\charrsid4867004 \par }\pard \qj \li720\ri720\sb240\sa200\widctlpar\aspalpha\aspnum\faauto\adjustright\rin720\lin720\itap0\pararsid10687304 {\f0\fs24\insrsid4673604\charrsid4867004 \loch\af0\dbch\af254\hich\f0 \'93}{\b\f0\fs24\insrsid4673604\charrsid4867004 \hich\af0\dbch\af254\loch\f0 On second appeal, the Court of Appeal\hich\af0\dbch\af254\loch\f0 is precluded from questioning the findings of facts of the trial court provided that there was evidence to support those findings though it may think it possible or even probable that it would not have itself come to the same conclusion; it can only inte \hich\af0\dbch\af254\loch\f0 r\hich\af0\dbch\af254\loch\f0 \hich\f0 fere where it considers that there was no evidence to support the finding of fact this being a question of law.\'94 \par }\pard \qj \li0\ri0\sb240\sa200\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12082901 {\f0\fs24\insrsid14096665\charrsid4867004 \hich\af0\dbch\af254\loch\f0 Having stated the legal position regarding the role of a second appellate court, like this one, the imposing question to consider now is whethe\hich\af0\dbch\af254\loch\f0 r there was evidence in the instant case to support the concurrent findings of facts of the }{\f0\fs24\insrsid14947601\charrsid4867004 \hich\af0\dbch\af254\loch\f0 trial}{\f0\fs24\insrsid14096665\charrsid4867004 \hich\af0\dbch\af254\loch\f0 and first appellate courts.}{\f0\fs24\insrsid4673604\charrsid4867004 \par }{\f0\fs24\insrsid14947601\charrsid4867004 \hich\af0\dbch\af254\loch\f0 In finding that robbery was committed at the UWFT, Masaka Branch on 25}{\f0\fs24\super\insrsid14947601\charrsid4867004 \hich\af0\dbch\af254\loch\f0 th}{ \f0\fs24\insrsid14947601\charrsid4867004 \hich\af0\dbch\af254\loch\f0 October 1999, the learned trial judge said:}{\f0\fs24\insrsid14096665\charrsid4867004 \par }\pard \qj \li720\ri576\sb240\sa200\widctlpar\aspalpha\aspnum\faauto\adjustright\rin576\lin720\itap0\pararsid15606995 {\b\i\f0\fs24\insrsid11034572\charrsid4867004 \loch\af0\dbch\af254\hich\f0 \'93\loch\f0 Sarah Nsimbe\hich\af0\dbch\af254\loch\f0 , the Branch Manager of UWFT testified as PW4. She testified that on the fateful day she was seated in her office. The Cashier/Accountant (PW2) and the }{\b\i\f0\fs24\insrsid15606995\charrsid4867004 \hich\af0\dbch\af254\loch\f0 temporary}{ \b\i\f0\fs24\insrsid11034572\charrsid4867004 \hich\af0\dbch\af254\loch\f0 Cashier, Nakanwagi Harriet (PW3) were balancing their books. All of a }{\b\i\f0\fs24\insrsid15606995\charrsid4867004 \hich\af0\dbch\af254\loch\f0 sudden}{ \b\i\f0\fs24\insrsid11034572\charrsid4867004 \hich\af0\dbch\af254\loch\f0 she heard noise }{\b\i\f0\fs24\insrsid15606995\charrsid4867004 \hich\af0\dbch\af254\loch\f0 a\hich\af0\dbch\af254\loch\f0 nd PW4}{\b\i\f0\fs24\insrsid11034572\charrsid4867004 \hich\af0\dbch\af254\loch\f0 (sic) rushed to the store after shouting that she was dying. Then she heard }{\b\i\f0\fs24\insrsid15606995\charrsid4867004 \hich\af0\dbch\af254\loch\f0 the noise}{\b\i\f0\fs24\insrsid11034572\charrsid4867004 \hich\af0\dbch\af254\loch\f0 of shoes indicating a scuffle. As she went to the banking hall, PW2 was running out and PW3 was running to the store. The assailant was holding the gun as if to sh\hich\af0\dbch\af254\loch\f0 oot. She ran back to her office and took cover. She heard his footsteps when he left and got the courage to come out. She went to the store and talked to PW# who briefed her about what happened. When she hear}{\b\i\f0\fs24\insrsid15606995\charrsid4867004 \hich\af0\dbch\af254\loch\f0 d the voice of Mpagi who had been in the field i\hich\af0\dbch\af254\loch\f0 n the banking hall, they came out. They were joined by PW2 who told}{\b\i\f0\fs24\insrsid3500001\charrsid4867004 \hich\af0\dbch\af254\loch\f0 them what happened. They checked }{\b\i\f0\fs24\insrsid7746318\charrsid4867004 \hich\af0\dbch\af254\loch\f0 what was missing and then went to police. Shillings 285,000= was missing. The matter was reported to Masaka Police Station. The witnesses gave their eviden\hich\af0\dbch\af254\loch\f0 \hich\f0 ce in straight forward manner which was not shaken by cross-examination. I accepted it as true. The first ingredient has therefore been proved beyond reasonable doubt.\'94}{\b\i\f0\fs24\insrsid14947601\charrsid4867004 \par }{\f0\fs24\insrsid7746318\charrsid4867004 \par }\pard \qj \li0\ri0\sb240\sa200\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12082901 {\f0\fs24\insrsid13317873\charrsid4867004 \hich\af0\dbch\af254\loch\f0 It is quite clear from the above passage from the judgment of the learned trial judge \hich\af0\dbch\af254\loch\f0 that she relied on the evidence of PW2, PW3 and PW4 to find as a fact that robbery was committed at the UWFT, Masaka Branch on 25}{ \f0\fs24\super\insrsid13317873\charrsid4867004 \hich\af0\dbch\af254\loch\f0 th}{\f0\fs24\insrsid13317873\charrsid4867004 \hich\af0\dbch\af254\loch\f0 October, 1999. \par }{\f0\fs24\insrsid8468562\charrsid4867004 \hich\af0\dbch\af254\loch\f0 On whether it was the appellant who committed that robbery, the learned trial judge considered the appellant\hich\f0 \rquote \hich\af0\dbch\af254\loch\f0 s alibi against his charge and caution statement which he later challenged that it was interpreted to him in Alur, a language he did not understand well, and the evidence of PW2, PW3 and PW4 who were the identifying witnesses as they }{ \f0\fs24\insrsid16404415\charrsid4867004 \hich\af0\dbch\af254\loch\f0 were}{\f0\fs24\insrsid8468562\charrsid4867004 \hich\af0\dbch\af254\loch\f0 at the scene of c\hich\af0\dbch\af254\loch\f0 rime and concluded that:}{ \f0\fs24\insrsid13317873\charrsid4867004 \par }\pard \qj \li720\ri720\sb240\sa200\widctlpar\aspalpha\aspnum\faauto\adjustright\rin720\lin720\itap0\pararsid12088889 {\b\i\f0\fs24\insrsid12088889\charrsid4867004 \loch\af0\dbch\af254\hich\f0 \'93\loch\f0 \hich\f0 I have considered the above evidence in its totality. I am satisfied that the prosecution witnesses identified the accused person at the scene of crime and that his alibi is false.\'94}{\b\i\f0\fs24\insrsid4673604\charrsid4867004 \par }\pard \qj \li0\ri0\sb240\sa200\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12082901 {\f0\fs24\insrsid12088889\charrsid4867004 \hich\af0\dbch\af254\loch\f0 There can }{\f0\fs24\insrsid14449040\charrsid4867004 \hich\af0\dbch\af254\loch\f0 be no doubt from the above passage tha\hich\af0\dbch\af254\loch\f0 t the learned trial judge relied on the totality of evidence on record including the evidence of PW2, PW3 and PW4 who were the identifying witnesses to find as a fact that the appellant participated in the robbery. This in our view dispels the argument of \hich\af0\dbch\af254\loch\f0 \hich\af0\dbch\af254\loch\f0 Mr. Rukundo that there was no evidence other than the appellant\hich\f0 \rquote \loch\f0 s uncorroborated retracted confession, to support the conviction.}{ \f0\fs24\insrsid12088889\charrsid4867004 \par }{\f0\fs24\insrsid15949080\charrsid4867004 \par }{\f0\fs24\insrsid14955943\charrsid4867004 \hich\af0\dbch\af254\loch\f0 The learned trial judge indeed considered the confession which she treated rightly in our view, as retracted and warned herse\hich\af0\dbch\af254\loch\f0 lf of the dangers of acting on such evidence without corroboration unless she was satisfied that it was true. \par }{\f0\fs24\insrsid1013722\charrsid4867004 \hich\af0\dbch\af254\loch\f0 In the instant case, the learned trial judge was satisfied that the confession was true and gave reasons for that view. \par \hich\af0\dbch\af254\loch\f0 According to her, the conf\hich\af0\dbch\af254\loch\f0 ession tallied with the evidence of PW2, Pw3 and Pw4 which put him at the}{\f0\fs24\insrsid4790263\charrsid4867004 \hich\af0\dbch\af254\loch\f0 scene of crime where he staged a robbery and also showed that he disappeared from his duty station after the robbery incident. It also tallied with the evidence of DW1 which showed t\hich\af0\dbch\af254\loch\f0 hat the appellant went to the witness \hich\f0 \rquote \loch\f0 s home in the evening of the day of the robbery, got drunk there and left his gun with the witness. It }{\f0\fs24\insrsid3817613\charrsid4867004 \hich\af0\dbch\af254\loch\f0 further}{\f0\fs24\insrsid4790263\charrsid4867004 \hich\af0\dbch\af254\loch\f0 tallied with the evidence of PW5 which showed that the appellant disappeared from his home after the robber\hich\af0\dbch\af254\loch\f0 y incident causing PW5 to accompany the appellant\hich\f0 \rquote \loch\f0 s sister to report his disappearance to the police. \par }{\f0\fs24\insrsid2244360\charrsid4867004 \hich\af0\dbch\af254\loch\f0 The retracted confession was therefore used as corroboration of the evidence of the identifying witnesses and other circumstantial evidence. \par }{\f0\fs24\insrsid13524848\charrsid4867004 \hich\af0\dbch\af254\loch\f0 We have perus\hich\af0\dbch\af254\loch\f0 ed the record and are satisfied that the learned Justices of Appeal re-evaluated the evidence on record and found that the charge and caution statement tallied with the prosecution evidence. It must be noted that there is no standard procedure of re-evalu \hich\af0\dbch\af254\loch\f0 a\hich\af0\dbch\af254\loch\f0 tion of evidence by a first appellate court. \par \par \par }{\f0\fs24\insrsid15928241\charrsid4867004 \hich\af0\dbch\af254\loch\f0 While it may be desirable to show that the evidence on record has been re-weighed by the first appellate court, that is not the standard procedure. In the instant case, we have no doubt that the learned Justic\hich\af0\dbch\af254\loch\f0 es of Appeal re-evaluated the evidence and agreed with the trial judge\hich\f0 \rquote \loch\f0 s findings of facts. }{\f0\fs24\insrsid13524848\charrsid4867004 \par }{\f0\fs24\insrsid3939243\charrsid4867004 \hich\af0\dbch\af254\loch\f0 We have pointed out earlier in this judgment, that the role of a second appellate court is to find out whether the concurrent findings of the two lower courts can \hich\af0\dbch\af254\loch\f0 be supported by evidence on record.
