Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the appellants pleaded and proved fraud against the respondent in acquisition of the suitland.
  2. 2 Whether the appellants had any lawful or customary interest in the suitland.
  3. 3 Whether the trial Chief Magistrate properly evaluated the evidence on record.

Ratio Decidendi

The appeal was dismissed because the appellants failed to specifically plead and strictly prove fraud in the acquisition of the suitland by the respondent. The evidence presented by the appellants was contradictory and did not establish any lawful or customary interest in the suitland. The respondent's certificate of title, obtained after proper inspection and survey, was upheld as conclusive evidence of ownership. The trial Chief Magistrate properly evaluated the evidence and conducted the locus in quo proceedings without occasioning any miscarriage of justice. The appellants' claims were found to be unsupported by credible evidence, and all grounds of appeal failed.

Court Disposition

appeal dismissed

Orders

  • The appeal is dismissed with costs to the respondent.
