The appellant lacked locus standi to claim the land as he was neither the owner nor the legally appointed manager of his mother's estate. The alleged gift of land to the appellant's mother was not sufficiently certain, as the boundaries and subject matter were indeterminable and not proved with evidence. The trial court's error in recording evidence from independent witnesses at the locus in quo did not result in a miscarriage of justice, as there was sufficient evidence to support the decision independently. The presumption of mental competence applies unless a person is certified by court as of unsound mind, and no such certification or appointment existed for the appellant's mother....
