Ratio Decidendi

The court found that the 2nd Defendant had executed both a Power of Attorney and a personal guarantee in favour of the 1st Defendant, as evidenced by the registered documents tendered in court. The guarantee deed made the 2nd Defendant solely liable for the debt upon default by the 1st Defendant. The Plaintiff was entitled to recover the outstanding sum, interest at the contractual rate from the date of filing until payment in full, and to foreclose on the property mortgaged as security, but only as regards Plot 452, since Plot 451 was not part of the security. The Plaintiff's claim was proved on a balance of probabilities, and judgment was entered accordingly.
