The court found that the plaintiffs proved on a balance of probabilities that they are the rightful owners of the 149.63 hectares of land included in certificate of title LRV 1186 FOLIO 17 at Omatenga, Kumi, having inherited and occupied the land for decades, with evidence of ancestral graves and clan lineage. The title was fraudulently acquired by the late Ogwang David Livingstone without the plaintiffs' consent, through forceful survey and misrepresentation, and not lawfully obtained. The fraud was attributed to the late Ogwang, not the 1st defendant. The plaintiffs' action was not time barred, as they only discovered the title in 2014 and filed suit the same year.
