The record shows that service was effected on 25th May 2023, well outside the statutory twenty-one day period. No application for extension of time was made within the fifteen days after expiry, and there was no affidavit of service on record. The provisions of Order 5 rule 1(2) and (3) of the Civil Procedure Rules are mandatory and leave no discretion to the court; failure to comply results in automatic dismissal of the application.
