Procedural Posture

Land Appeal / Judgment

  1. 1 Who is the rightful owner of the suit land measuring 120 acres located at Igulu cell, Kungu parish, Akokoro subcounty, Apac District?
  2. 2 Whether the appellant/defendant trespassed on the suit land?
  3. 3 Whether the amended memorandum of appeal was properly filed with leave of court?

Ratio Decidendi

The High Court found that the trial magistrate properly evaluated the evidence and correctly determined that the respondents are the customary owners of the suit land. The appellant's claim of ownership was unsupported by credible evidence, and the testimonies of his witnesses were inconsistent regarding burial sites and land distribution. The appellant was granted only temporary access and subsequently trespassed on the respondents' land. The amended memorandum of appeal was struck out for lack of leave of court, leaving only one ground for determination, which failed. The appeal was dismissed, and costs were awarded to the respondents.
