The Court of Appeal found that the sentence of 20 years imprisonment imposed on the appellant for aggravated defilement of his biological daughter was neither excessive nor harsh. The trial judge had properly considered both mitigating factors (first offender, relatively young, children to support, period spent on remand) and aggravating factors (defilement of own biological daughter, breach of parental duty, victim's young age). The sentence was consistent with sentences imposed in similar cases and was not illegal. The appeal was dismissed and the sentence upheld.
