The court found that the meetings of 15th November 2022 and 9th January 2023, which culminated in the removal of the applicant from the office of Chairman General of NOTU, were convened in contravention of the NOTU Constitution and the Labour Unions Act. The process was tainted by illegality, procedural impropriety, and irrationality, as the proper procedures for convening such meetings were not followed, and the applicant was not afforded a fair hearing. The Registrar of Trade Unions had also advised that the meetings and their resolutions were illegal.
