The appeal was allowed because the trial Magistrate failed to properly conduct and record the locus in quo proceedings, introducing new witnesses who had not previously testified and failing to make necessary observations or records. This procedural irregularity rendered the trial a nullity. Additionally, the plaint disclosed a cause of action only against the 1st defendant, not the 2nd. The suit was also found to be time-barred under Section 5 of the Limitation Act, as the alleged trespass began in 1964 and the limitation period had expired. The lower court's judgment was set aside and replaced with a finding for the appellants.
