Procedural Posture

Miscellaneous Application / Application for Leave to Withdraw

  1. 1 Whether leave should be granted to withdraw Miscellaneous Application No. 22/2023.
  2. 2 Whether any order as to costs should be made upon withdrawal.

Ratio Decidendi

The Court found that since Miscellaneous Application No. 22/2023 had formally come before it, withdrawal required leave under Order 25 Rule 1(2) of the Civil Procedure Rules SI 71-1. The absence of service and responsive pleadings did not occasion prejudice to the Respondent, who was neither present nor represented. The prompt withdrawal spared the Respondent further litigation, especially given the age of the main suit. The Court exercised its discretion to grant leave for withdrawal and ordered that each party bear its own costs, returning the main file to the Chief Magistrate's Court for any further action.

Court Disposition

Application for leave to withdraw granted; application withdrawn.

Orders

  • The Application for grant of leave to withdraw Miscellaneous Application No. 22/2023 is hereby granted and the Application stands withdrawn.
  • Each party shall bear its own costs.
