There was no evidence of inordinate delay or indolence by the applicant. The subject matter is land, which is of significant importance to the applicant's livelihood. No prejudice to the respondent was demonstrated, and the interests of justice favor determination of the dispute on its merits. The court held that mistakes of counsel should not be visited on the litigant, and access to justice should be balanced against finality of litigation.
