The Tribunal determined that its jurisdiction is limited by Section 91I(3)(a) of the Public Procurement and Disposal of Public Assets Act, which precludes review of decisions to reject all bids prior to contract award if such rejection is conducted in accordance with the Act and the bidding documents. The evidence showed that the Evaluation Committee recommended rejection of all bids due to non-compliance, and this recommendation was approved by the Contracts Committee before any contract award. The rejection was therefore valid under the law, and the Tribunal is barred from reviewing the reasons for the rejection. Consequently, the Tribunal struck out the application and vacated its...
