The application was rejected because the relief sought was already pending determination in an earlier application (Misc. Application No. 624 of 2009) before another judge, and the prayers were duplicative. The judge held that it was an abuse of process to file a second application for the same relief and that, by law, subsequent proceedings should be taken before the judge who heard the original matter. Furthermore, the absence of proper service on the respondents' new advocates meant the respondents would be condemned unheard if the orders were granted. The applicants were advised to pursue the reliefs in the earlier application, either as substantive reliefs or as consequential orders...
