The Court found that there was no acknowledged receipt of the notification of the Application initiating proceedings and that the Respondent State expressly stated it did not receive such notification. In the interest of justice and to uphold the principle of adversarial proceedings, the Court exercised its discretion under Rule 46(3) to reopen the proceedings. This allows the Respondent State the opportunity to file its Response and submissions on reparations, ensuring both parties are heard and procedural fairness is maintained.
