Ratio Decidendi

The court found that, as no defence was filed and default judgment was entered for the liquidated sum, the Plaintiff's claim for UGX 94,050,000 was admitted. The Plaintiff was entitled to judgment for the amount claimed. The court declined to award general damages, noting that under Order 9 Rule 6, only interest is provided for, not general damages. Interest was awarded at 15% per annum from the date of judgment until payment in full, as the rate sought by the Plaintiff (25%) was deemed excessive.
