The court found that the defendants breached the sale agreement by subdividing the land into three plots instead of two, contrary to clause 7 which required demarcation from the vacant area closer to the gate. The defence failed to prove that the plaintiff consented to the mutation or was present during the survey, and no signed mutation form was produced. The road was not intended to be surveyed onto the plaintiff’s land, and the demarcation denied him access and constituted trespass. The court held that the plaintiff was entitled to general damages for trespass and mesne profits, and ordered the Commissioner Land Registration to amalgamate the plots and re-demarcate the land into two...
