The court found that the applicants had established a prima facie case regarding the property of the 2nd applicant, as the pleadings raised serious issues meriting trial and there was no rebuttal of the existence of the loan facility or the sale of the suit land by the 1st respondent. However, the court noted that the property belonging to the 3rd applicant had already been transferred to the 4th respondent, making the grant of an injunction in respect of that property futile.
