Ratio Decidendi

The Plaintiff, having advanced loans secured by a legal mortgage and complied with statutory notice requirements under the Mortgage Act, was entitled to exercise the remedy of sale after the Defendant's default. The Defendant failed to contest the Plaintiff's evidence or respond to notices, resulting in uncontested liability. The Plaintiff is therefore entitled to vacant possession of the mortgaged property and to evict the Defendant and his agents, enabling handover to the purchaser. As the successful party, the Plaintiff is also entitled to costs of the suit under Section 27 of the Civil Procedure Act.

Court Disposition

All questions answered in the affirmative. Judgment for the Plaintiff.

Orders

  • The Defendant shall deliver vacant possession of the suit property comprised in Freehold Register Volume HQT1757 Folio 4 Block (Road) 37 Plot 34 at Shozi Cell, Gasiza Parish, Nyakabande Division Kisoro Municipality, Kisoro District to the Plaintiff.
  • The Plaintiff is awarded costs of the suit.
