Procedural Posture

Civil Suit / Final Ruling and Order

  1. 1 Whether the Departed Asians Property Custodian Board (DAPCB) had legal capacity to reject the plaintiffs' application for repossession of the suit property.
  2. 2 Whether the sale and subsequent transactions involving the suit property were nullified by the Expropriated Properties Act, 1982.
  3. 3 Whether the plaintiffs' suit was properly brought as an original suit or should have been an appeal under Section 14 of the Expropriated Properties Act.

Ratio Decidendi

The court held that the Departed Asians Property Custodian Board (DAPCB) had no legal authority under the Expropriated Properties Act to receive or reject applications for repossession of expropriated property, as such powers are vested exclusively in the Minister. All transactions involving the suit property prior to the coming into force of the Act were nullified, and the property reverted to Government. The plaintiffs' suit, brought as an original action against the DAPCB and other defendants, was misconceived and incompetent, as any challenge to the Minister's issuance of a certificate of purchase to the third defendant should have been brought as an appeal under Section 14 of the Act...
