Ratio Decidendi

The Respondents, having been duly served with court orders, decrees, and certificates of order, failed to comply or provide any explanation for noncompliance. Their conduct constitutes wanton disobedience and contempt of court. The purported compulsory acquisition of the suit property by the Government, through the Minister for Lands, was unlawful and ineffective, as it contravened constitutional requirements for prior compensation. The Applicant is entitled to remedies including payment of sums due, vacant possession, and costs. The Respondents are ordered to purge their contempt within 30 days, failing which they may be committed to civil prison. The compulsory acquisition is declared...
