The subsequent administrative transfer of the suit to the High Court was irregular because the Chief Magistrate's Court lacked jurisdiction from the outset. Under Section 18 of the Civil Procedure Act and established case law, a suit can only be transferred if it was properly filed in a court with jurisdiction.
