Despite one serious misdirection and other minor misdirections by the trial Judge regarding the effect of certain evidence, the appellate court found that the overall evidence against the appellant was overwhelming. The Judge's conclusions regarding the credibility of witnesses and the improbability of the appellant's financial explanations were justified. The misdirections did not materially affect the outcome, as the evidence established the appellant's involvement in the conspiracy to obtain money by false pretences. The appeal was dismissed because, even absent the misdirections, the Judge must in reason have arrived at the same conclusion based on the record.
