Ratio Decidendi

The Court held that the offence of publishing a seditious publication under section 53(1)(c) of the Uganda Penal Code does not require extrinsic evidence of intention beyond the words themselves. If the publication, on its face, contains a seditious intention as defined by the Code, that is sufficient to establish the offence. Furthermore, the Court determined that the statutory framework intentionally excludes the requirement of mens rea for this offence. The legislature has made it a matter of policy to punish anyone who publishes a seditious publication, regardless of their knowledge or intent, thereby placing the onus on publishers to ensure that their publications are not seditious....
