Although the Magistrate's procedure in personally fetching a witness was highly unusual and not encouraged, it did not vitiate the proceedings in the absence of any prejudice to the appellant. The conditions under which the Magistrate was working were exceptional, with no prosecutor or police officers present to assist. The evidence of the station-master was given in open court, in the presence of the accused, who had full opportunity to cross-examine. There was no suggestion or evidence that the Magistrate improperly influenced the witness. The case is distinguishable from Rex v.
