Ratio Decidendi

The court held that the transfer of the case from the Resident Magistrate to the Second Class Magistrate was valid under section 77(a) of the Criminal Procedure Code, as the accused was informed of his right to have the witness reheard and declined. The omission of the phrase 'whether evidence has been taken or not' in section 77(a) was not material, and the procedure followed was proper. However, the conviction for being in possession of cattle under section 10 of Ordinance 18/33 could not stand, as the accused was charged with theft under section 255 of the Penal Code, and section 174 of the Criminal Procedure Code does not permit conviction for a wholly different offence not charged....
