The confession upon which the conviction was based was made while the accused was in custody of tribal retainers, who are considered police officers for the purposes of the Indian Evidence Act. Therefore, the confession was inadmissible, regardless of its voluntariness or the accused's subsequent admission of having made it. The magistrate erred in relying on the confession, and no statement by the accused could cure its inadmissibility. As a result, the conviction and sentence could not stand.
