Ratio Decidendi

The Court held that the appellant's belief that his wife intended to poison or bewitch him was unreasonable when judged by the standard of the ordinary villager. The evidence did not establish that the deceased performed any act in the actual presence of the accused which could be genuinely believed to be witchcraft, nor was there a sudden provocative act as required by law. Belief in witchcraft alone, without an immediate and physical act, cannot constitute legal provocation under sections 198 and 199 of the Penal Code. The appellant's plea of provocation therefore fails, and his conviction for murder stands.
