[1943] EACA 66

The court held that Rule 6(a) of the Traffic (Motor Omnibus) Rules, 1940, which prohibits passengers from using obscene or offensive language or behaving in a riotous or disorderly manner, was made ultra vires the powers conferred by section 49 of the Traffic Ordinance, 1928. Section 49 empowers the Governor in Council to make rules relating to motor omnibus attendants and vehicles, not passengers. Section 49(z) does not extend to regulating passenger conduct, as its fair interpretation is limited to the use of vehicles by those permitted to ply them and their servants. Therefore, the conviction and sentence based on Rule 6(a) cannot stand.
