Miscellaneous Application / Ruling

  1. 1 Does the Industrial Court have jurisdiction to extend time and validate a notice of appeal filed out of time?
  2. 2 Is the application for stay of execution maintainable in the absence of a valid notice of appeal or appeal?
  3. 3 Should the application for stay of execution and extension of time be granted in the circumstances presented?

Ratio Decidendi

The Industrial Court does not have jurisdiction to extend time for filing a notice of appeal or to validate a notice of appeal filed out of time. Such powers are exclusively vested in the Court of Appeal under the relevant statutory and procedural rules. The applicant's notices of appeal were either not properly served or filed out of time, and the applicant expressly disavowed the initial notice. Without a valid notice of appeal or appeal before the appellate court, the Industrial Court cannot entertain an application for stay of execution or preserve the status quo pending appeal. The application is therefore dismissed for lack of jurisdiction and absence of a valid appeal process.
