The court found that a valid employment contract existed between the plaintiff and defendant, set to commence on 3rd January 2001, with a six-month probationary period. The defendant repudiated the contract prematurely on 29th August 2000, before the effective commencement of employment, without providing notice or justification as required by law and the contract terms. The familiarization period was not part of the probationary period, and the defendant's unilateral decision to treat it as such was arbitrary and contrary to the contract. The defendant's subsequent re-offer of employment did not constitute genuine mitigation, as it was motivated by fear of damages rather than good faith....
