Ratio Decidendi

The appeal was found to be incompetent and illegal because the notice of appeal was filed one year and four months after sentencing, well outside the statutory fourteen-day period, and without any application for extension of time. Furthermore, the appellant, having pleaded guilty, could only appeal against sentence with leave of the Court of Appeal, which was neither sought nor granted. The procedural lapses, including failure by counsel to address these legal requirements, rendered the appeal fatally defective. The Court of Appeal therefore had no jurisdiction to entertain the appeal and struck it out.
