[2013] AfCHPR 44

The Court determined that, pursuant to Rule 58 of the Rules of Court, when an applicant notifies the Registrar of their intention not to proceed with a case, the Court must strike the application off its cause list unless the respondent has already taken measures to proceed with the case. In this matter, at the time the Registry received the applicant's notice of discontinuance, the respondent had not taken any measures to proceed. Therefore, the respondent's consent was not required, and the application was properly struck out from the cause list.
