Ratio Decidendi

The application for dismissal of Civil Suit No. 141 of 2022 on grounds of res judicata fails because only one of the three required elements is satisfied. Although the parties are the same and litigating under the same title, the previous proceedings (Miscellaneous Cause 147 of 2021) were not decided by a court with competent jurisdiction over the substantive contractual claim for rent arrears and damages. The earlier suit was limited to leave to levy distress, a distinct remedy, and did not adjudicate the contractual issues now before the court. The doctrine of res judicata therefore does not apply, and the applicant's request for dismissal is denied.
