Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the trial judge followed the correct procedure in recording the appellant's plea of guilty.
  2. 2 Whether the sentence imposed was manifestly harsh and excessive in the circumstances.

Ratio Decidendi

The trial judge followed the correct procedure in recording the appellant's plea of guilty, as the indictment and ingredients of the offence were explained to the appellant in a language he understood, and he admitted the facts. Any alleged omission did not occasion a failure of justice, and no objection was raised during trial. The sentence of 30 years' imprisonment was within the permissible range under the Sentencing Guidelines and consistent with sentences imposed in similar cases. The trial judge considered both aggravating and mitigating factors, and the sentence was neither harsh nor excessive. The appeal fails on both grounds and is dismissed.
