The applicant, as the registered proprietor of the suit land, holds a certificate of title which is conclusive evidence of ownership under Section 59 of the Registration of Titles Act. The respondent failed to rebut the applicant's affidavit or provide any evidence of a valid claim or fraud. The powers of attorney relied upon by the respondent terminated upon the death of one donor, and the surviving donor is not a beneficiary of the estate in question. The respondent's caveat, therefore, lacks legal basis and unjustly fetters the applicant's rights to freely transact with his land. The court finds that the caveat must be removed and the applicant is entitled to costs.
