The Court of Appeal found that, following the death of the plaintiff (registered proprietor of the suit property) and the grant of letters of administration to the respondent, the suit property vested in the administratrix in trust for all beneficiaries, including the appellant. As a beneficiary, the appellant holds an equitable interest in the property and cannot be considered a trespasser prior to the distribution of the estate under the Succession Act. The trial judge failed to consider the legal effect of the plaintiff's death and the resulting change in the status of the property and parties.
