Ratio Decidendi

The court held that Administration Cause No. 396 of 2014 had already been concluded by the issuance of the letters of administration on July 9th, 2014. Therefore, it could not lapse or be struck out for want of prosecution as contended by the plaintiffs. The preliminary objection seeking to strike out a concluded suit was found to be misconceived. The proper procedure for challenging the grant is through an application for revocation of letters of administration, as provided for under the Succession Act. The issues raised in the preliminary objection are the same as those framed in the main suit, and the court directed that the suit proceed to hearing on its merits.
