The court held that once a petition for letters of administration has been concluded by the issuance of the grant, it cannot subsequently lapse or be struck out for want of prosecution, regardless of whether a caveat was lodged and a suit was not filed within the statutory period. The statutory provisions regarding lapse apply only before the grant is made. Since the grant had already been issued in Administration Cause No. 396 of 2014, the preliminary objection seeking to strike out the concluded cause was misconceived. The appropriate remedy for the Plaintiffs is to pursue revocation of the grant in the main suit, not to seek to strike out a concluded administration cause. The court...
