Ratio Decidendi

The court found that the majority of the evidence presented by the applicants was not new, as it was available and considered during the execution hearings. Only one document (annexure 'G') was created after the original rulings, but it did not directly pertain to the applicants' ability to pay the debt nor did it demonstrate a concrete arrangement with the respondent. The applicants failed to show that the new evidence was sufficiently important to have altered the outcome of the original decision. The statutory requirements for review under Order 46 rule 1(1) of the Civil Procedure Rules were not satisfied, and the applications were dismissed with costs to the respondent.
