The Court held that a betrothal contract arranged by a parent without the consent of the daughter is unenforceable in Uganda, as the daughter was not a party to the contract and the parent lacked authority to contract marriage for her. Marriage brokerage contracts are void as against public policy and do not confer enforceable rights. While the appellant may be entitled to recover gifts and money spent in contemplation of marriage, he cannot claim moral or intellectual damages, nor can he obtain an injunction restraining the second respondent from marrying another until restitution is made.
