Procedural Posture

Miscellaneous Application / Ruling on Interim Orders

  1. 1 Whether the Applicants are entitled to interim orders restraining the Respondent from holding new elections pending determination of the main Reference.
  2. 2 Whether the Applicants have demonstrated irreparable injury that cannot be compensated by damages if interim orders are not granted.
  3. 3 Whether the status quo should be maintained in favour of the Applicants until the Reference is disposed of.

Ratio Decidendi

The Court found that while the Application raised serious triable issues regarding alleged violations of the Treaty and domestic law, the Applicants failed to provide sufficient evidence of irreparable injury that could not be compensated by damages if interim orders were not granted. The Applicants' assertions of harm were speculative and unsubstantiated, and the possibility for the 1st Applicant to participate in future elections further undermined claims of irreparable harm. The Court held that the requirements for granting interim orders were not met, and therefore declined to grant the relief sought, dismissing the Application in its entirety.

Court Disposition
