The applicant failed to demonstrate any substantial loss that could not be compensated in monetary terms, as required by law. The application was filed with unreasonable delay, four years and eight months after judgment, which does not satisfy the condition of timely presentation. The likelihood of success of the appeal is not a ground to be considered by the trial court for a stay of execution. The applicant did not satisfy most of the mandatory conditions for grant of a stay of execution under Order 43 rule 4(3) of the Civil Procedure Rules. Consequently, the application for stay of execution must fail.
